Criminal Litigation
Opposed Bail Applications:
In opposed bail applications, the prosecution or another party challenges the defendant’s request for release pending trial. A bail hearing is conducted where arguments are presented regarding flight risk, danger to the community, or likelihood of re-offending.
Unopposed Bail Applications:
Unopposed bail applications occur when there is no opposition to the defendant’s request for release. The court considers factors such as the seriousness of the offense and the defendant’s ties to the community before granting bail.
After-Hours Bail Applications:
These are bail applications made outside regular court hours, typically during weekends, holidays, or after business hours. They are expedited to address the urgent need for determining whether the accused should be released before trial.
