Labour law

Labour law governs the relationship between employers, employees, and trade unions in the workplace. It encompasses rights, duties, and regulations aimed at ensuring fair treatment, safety, and equitable practices.

Representation at the CCMA:

The CCMA (Commission for Conciliation, Mediation and Arbitration) is a dispute resolution body in South Africa that handles disputes related to unfair dismissal, unfair labour practices, and other employment issues. Representation at the CCMA involves a legal representative or trade union advocate assisting employees or employers in presenting their case during conciliation or arbitration hearings.

Chairing of Disciplinary Hearings:

Disciplinary hearings are conducted to address allegations of misconduct or poor performance in the workplace. A chairperson, often a senior manager or HR representative, presides over these hearings. Their role includes ensuring procedural fairness, listening to evidence presented by both parties, and making decisions based on company policy and labour laws regarding the outcome of the hearing.

Labour law seeks to uphold fair treatment and balance the rights and responsibilities of employers and employees, fostering a productive and harmonious work environment while resolving disputes effectively.
